Reese’s adds bizarre warning to Halloween candy after $5 million lawsuit


Hershey has added a new warning to its Reese’s Halloween candy packaging following a $5 million lawsuit accusing the company of misleading customers.

The change affects Reese’s Milk Chocolate Peanut Butter Pumpkins, which feature an image of a chocolate pumpkin with a carved jack-o’-lantern face on the wrapper.

However, the actual candy doesn’t include the carved design, prompting complaints from customers who claimed the packaging was misleading.

According to the website’s product listing, Hershey has replaced the previous “Decorating Suggestion” message on its Reese’s Peanut Butter Pumpkins with a new disclaimer reading, “Carving not on actual product.”

The warning appears right beside the image of the decorated chocolate pumpkin.

The change comes after a class-action lawsuit was filed against Hershey in May 2024, with customers claiming they were misled into believing the chocolates would feature the carved faces shown on the packaging.

The plaintiffs argued that they purchased the candy for its decorative appearance and would not have bought it, or would have paid less, if they had known the chocolates were blank.

They claimed the candy lacked the “cool and beautiful carved-out designs” advertised on the wrappers.

Hershey disputed the allegations, arguing that the customers had not suffered any actual financial harm and were simply disappointed with the product’s appearance.

The original lawsuit was dismissed in September 2025, but the plaintiffs filed an amended complaint in December.

On September 16, 2026, a judge dismissed the amended complaint, ruling that the customers had failed to prove they suffered a financial injury or paid more because of the packaging.

The court also noted that the chocolates still had their advertised pumpkin shape, even without the carved faces.

“It is clear that their only injury is their subjective disappointment,” the judge stated.

Despite the lawsuit being dismissed, Hershey has updated its Halloween candy packaging to clarify that the decorative designs are not included on the chocolates.

The company has not confirmed whether the new warning was introduced in response to the lawsuit.
