Minnesota AI Nudification Ban Moves Forward After Judge Rejects xAI Appeal
According to a report from NBC News, US District Judge Donovan Frank rejected xAI’s request for a temporary restraining order for a law regarding the ban for nonconsensual “nudify” apps and websites. The company argues that the measure violates the First Amendment. However, the court found no evidence of immediate harm that would justify emergency intervention. The ban on AI Nudification tools was implemented on Saturday.
“Such a delay in bringing the action and the motion suggests that harm is not immediate,” Frank wrote, noting that xAI filed its challenge nearly three months after the law was signed and only days before implementation.
Elon Musk’s xAI filed a lawsuit back on July 29, 2026. The company claims that the lawsuit is overly broad and restricts protected forms of expression. This includes satire and artistic content. The court is said to revisit the lawsuit later this month. A hearing will be hosted on August 19 to determine whether a preliminary injunction should be granted.
The ruling was signed in May by Minnesota Governor Tim Walz. The legislation prohibits platforms from allowing users to generate or share AI-generated images that depict individuals in a sexualized or nude manner without their original likeness. Additionally, advertising these tools will also result in civil penalties of up to $500,000 per incident. This is on top of additional damages.
The case comes following the backlash from xAI’s Grok chatbot. Users fear the AI’s capability, specifically its image editing feature, where it can generate non-consensual deepfakes of individuals. State officials argue that the law is necessary to protect individuals from the growing misuse of AI-generated imagery.
